Terms of Service

These terms explain how PennyReply should be used by business owners and teams. They are written in plain language so the responsibilities are easy to understand before launch.
1. What PennyReply Provides
PennyReply provides AI receptionist software for service businesses. The product can help capture website leads, respond to missed calls, draft customer replies, organize conversations, support booking workflows, and route risky or unclear requests to a human.
PennyReply is a software platform. It does not replace the business owner, manager, licensed professional, or customer support team responsible for final business decisions.
2. Accounts and Business Setup
You are responsible for keeping account access secure and for making sure the business information in PennyReply is accurate. This includes services, pricing, service areas, hours, booking rules, refund policies, custom quote rules, and handoff instructions.
If PennyReply imports information from a website, you must review and approve that information before relying on it in customer conversations.
3. AI Replies and Human Review
AI-generated replies can be incomplete or incorrect. You are responsible for configuring confidence thresholds, handoff rules, banned words, required phrases, and approval rules before enabling automatic customer replies.
PennyReply should answer from approved business information. It should not be used to invent prices, guarantee outcomes, make regulated claims, approve refunds, or confirm unavailable appointment times.
4. Customer Communications
You are responsible for making sure you have permission to message or call customers through PennyReply. This includes SMS, missed-call text back, follow-ups, review requests, booking reminders, and any future voice features.
You may not use PennyReply to send spam, misleading offers, unlawful messages, harassing messages, or communications to people who have opted out. SMS users must be able to reply STOP to opt out and HELP for help.
5. Payments, Deposits, and Quotes
If payment or deposit collection is enabled, you are responsible for confirming the amount, refund policy, service scope, and appointment details before charging a customer.
Custom quotes, complaints, refunds, regulated services, safety-sensitive requests, and unclear requests should be routed to a human unless you have intentionally configured a safe rule for them.
6. Subscriptions, Usage, and Setup
Paid plans may include limits for SMS, AI conversations, bookings, calendar connections, phone numbers, staff seats, locations, follow-ups, review requests, and other features. Usage limits help keep pricing fair.
The One-Time Setup & Automation Buildout covers initial business setup, services and pricing setup, FAQs, hours, booking rules, calendar, phone, SMS, widget setup, and bot testing before launch unless a separate agreement says otherwise.
7. Acceptable Use
Do not use PennyReply for illegal activity, deceptive marketing, abusive communications, fraud, credential harvesting, regulated advice without proper oversight, or attempts to bypass security, usage limits, or carrier rules.
We may limit, suspend, or disable access if use of the product creates security, compliance, deliverability, billing, or platform risk.
8. Third-Party Services
PennyReply may connect with services such as Supabase, Vercel, Twilio, Stripe, Google Calendar, Gemini, OpenAI-compatible AI providers, website builders, analytics tools, and email providers. Those services have their own terms and availability.
PennyReply is not responsible for outages, delays, filtering, carrier restrictions, payment declines, calendar provider errors, or policy enforcement by third-party providers.
9. No Legal, Financial, or Professional Advice
PennyReply does not provide legal, tax, financial, medical, insurance, or other professional advice. You should talk with a qualified professional for advice specific to your business, industry, location, or compliance requirements.
